Partner João Paulo da Silveira Ribeiro, in the figure of Chairman of the Commission for Works, Concessions and Control of Public Administration of the Federal Council of the OAB, issued an official note last Tuesday, 29th, repudiating the act of destruction of the toll Concessionária Lamsa S.A., held last Sunday, 27th, by the City Hall of Rio de Janeiro.
In the note, it was highlighted that, despite the prerogatives that the Granting Authority has to supervise and manage the granted object – among them, the sanctioning of concessionaires -, all acts performed must comply with the constitutional and legal frameworks in force, in particular, the dictates listed in Law No. 8.987/95.
Despite this, in this case, such legal provisions were not respected, which is why the guardianship was granted on Monday, 28th, suspending the acts practiced before the toll of Yellow Line. Furthermore, the disrespect for publicity and guarantees of form, time and place of administrative acts by the Municipality of Rio de Janeiro was highlighted in the court order, as provided for in Federal Law No. 9.784/99.
